General provisions
These terms of use of the kudo-paint.com website (hereinafter — the Site) define the rules for using the materials of the Site and the procedure for processing users’ personal data. The Site is owned and administered by KUDO® Trading House LLC (taxpayer number INN 5031138801) (hereinafter — the Company). Continued use of the Site means acceptance of the terms of use of its materials. Consent to the processing of data from the forms and to analytics is given separately, in the manner described below. If the user does not agree with the terms, they must immediately stop using the Site.
The Company reserves the right to change the content of the Site and these terms (including the legal information) at any time without prior notice. We recommend reviewing the current version of the terms on the Site from time to time to keep up with the applicable rules. All materials posted on the Site are protected by intellectual property law; any unauthorized use of them may violate the legislation of the Russian Federation. This page provides an English translation of the original Russian terms and personal data processing policy. The Russian-language version prevails.
Information about products on the Site
All information presented on the Site (including information about KUDO® products, their specifications and configurations) is provided for reference only. These materials may contain inaccuracies, typographical and other errors and are not complete, current or exhaustive. The Site administration does not warrant the accuracy and completeness of the information posted. To obtain accurate and current information about the products, please contact representatives of the Company directly (the contacts are given in the relevant section of the Site).
The materials about products and services posted on the Site do not constitute a public offer or an invitation to make an offer within the meaning of Article 437 of the Civil Code of the Russian Federation. The information on the Site does not constitute terms of sale or of provision of services that are binding on the Company. The fact that an order cannot be placed through the Site means that the product descriptions presented are for reference and cannot be regarded as exhaustive or guaranteed to be accurate.
Personal data processing policy
The Company collects and processes the personal data of users of the Site in accordance with the applicable legislation of the Russian Federation, including Federal Law No. 152-FZ “On Personal Data”. Personal data is processed on a lawful and fair basis, solely for the purposes arising from the operation of the Site and from interaction with users. Personal data collected through the Site. The user provides personal data on the Site voluntarily — for example, when filling in feedback forms and requests or when adding comments.
Through the forms of the Site the user may provide the following data: name; email address; contact telephone number; city and region; the text of the enquiry; the selected product and the text of the question. The date and time are recorded when the form is submitted. The IP address, User-Agent and technical attributes of the request may be processed by the means of protection against automated requests and in technical logs.
By ticking the consent box and submitting a form on the Site, the user gives consent to the processing of the data provided in order to answer the enquiry. Purposes of personal data processing.
The Company processes users’ personal data solely for the purposes for which it was provided, including: to establish feedback with the user and to answer their requests, questions or comments; to provide the information about the Company’s products and services requested by the user; to publish the user’s review or comment on the Site (if the user has submitted a comment and has agreed to its publication); to improve the operation of the Site and to analyze user enquiries and the convenience of using the resource; to send the user advertising or news information (for example, about new products or promotions), but only where the user has given separate consent to receive such mailings.
Personal data is processed both with and without the use of automation tools. The Company has the right to perform any operations with personal data, including collection, recording, systematization, accumulation, storage, updating (renewal, modification), retrieval, use, transfer (provision, access), depersonalization, blocking, deletion and destruction of the data.
All personal data is stored in protected systems of the Company or of its authorized technical partners, with the necessary protection measures in place. The Company warrants that users’ personal data is processed in accordance with the requirements of the applicable legislation of the Russian Federation and solely for the purposes stated.
The Company does not disclose personal data to third parties and does not distribute it without the consent of the data subject, except in cases expressly provided for by law or where the data has to be provided at the lawful request of authorized government bodies.
Retention periods and publication of questions
The data of product questions, including the name, email address, the text of the question, the selected product and the date of submission, is stored without a predetermined period — for as long as the purposes of maintaining the questions and answers database remain, or until consent is withdrawn, if there is no other lawful basis for continuing the processing. The data of other enquiries is stored for the period required to answer them, to conduct business correspondence, to protect the rights of the Company and to comply with the requirements of the legislation of the Russian Federation.
After moderation, the text of the question, the Company’s answer and the name given by the author may be published on the Site. The email address and the technical data of the request are not published on the Site. The user should not include in the text of the question any information that they do not want to make publicly available.
Personal data processing consent
By ticking the consent box and clicking the form submit button, the user freely, by their own will and in their own interest gives KUDO® Trading House LLC consent to the processing of the personal data specified in the form and listed above for the purposes related to the selected form.
The consent covers processing both with and without the use of automation tools and permits the collection, recording, systematization, accumulation, storage, updating, retrieval, use, provision of access to authorized employees and technical partners, blocking, deletion and destruction of the data.
When submitting a question about a product, the user is notified of and agrees that, after moderation, the name and the text of the question they have given, together with the Company’s answer, may be posted publicly on the page of the corresponding product. The email address, IP address and User-Agent are not published.
The consent is valid until the purposes of processing are achieved or until it is withdrawn, and for the questions and answers database — without a predetermined period. Consent can be withdrawn by writing to info@kudo-paint.ru. Once the withdrawal has been received, the Company stops the processing and deletes the data within the period established by law, except in cases where the processing may be continued on another lawful basis.
Intellectual property
All items posted on the Site (texts, descriptions, illustrations, photographs, design, audio and video materials, program code and others) are items of intellectual property. The exclusive rights to these materials belong to KUDO® Trading House LLC, unless expressly stated otherwise. KUDO® Trading House LLC uses the KUDO® trademark on lawful grounds, with the written consent of the rights holder Trol-Avto LLC (ООО «Троль-Авто»). Materials created by third parties and posted on the Site with the consent of the rights holders (for example, partner logos, trademarks of third-party companies) belong to their lawful owners. Any use of the materials of the Site without prior written permission of the rights holder is strictly prohibited. Use includes, among other things: copying, reproduction, adaptation, distribution, display in any form, publication, translation, or any other exploitation of the materials of the Site that goes beyond personal familiarization. Unauthorized use of the content of the Site may entail liability under the applicable legislation (including copyright and trademark law). Permission to use the materials of the Site must be requested directly from the Company.
Disclaimer
The Site and all materials on it are provided on an “as is” basis, without any express or implied warranties. The Company does not warrant the error-free and uninterrupted operation of the Site, that the materials will meet users’ expectations, or that the information will be permanently updated and current. The Site administration will make reasonable efforts to keep the information current and the resource operational, but is not liable for the accuracy, completeness and currency of the information presented on the Site. KUDO® Trading House LLC (the Site administration), its affiliates, partners or suppliers will not be liable for any direct or indirect damages, lost profit, lost opportunities or any other losses incurred by users as a result of the use of the materials of the Site or of the inability to use the Site. In particular, the Company is not liable for damage caused as a result of the user’s actions based on information obtained on the Site, or for the consequences of technical failures, temporary unavailability of the Site, loss of the user’s data or other technical problems in accessing the Site. The user uses the Site and the information posted on it at their own risk. The Site may contain links to web pages or resources of third-party organizations for the user’s convenience (for example, to the websites of distributors and partners or to social networks). Such links are provided for information purposes only. The Company does not control third-party resources and is not liable for their content, availability or compliance with the law. By following an external link, the user leaves the Company’s Site, and further relations are governed by the terms of use and privacy policy of the corresponding third-party resource.
Governing law: the legislation of the Russian Federation. All disputes are subject to resolution in court at the location of the Company.
Final provisions: The invalidity or unenforceability of any provision of these terms does not entail the invalidity of the remaining provisions. The absence of a direct demand from the Company for strict performance of any clause of the terms does not mean a waiver of the corresponding right. The current version of this Public Offer and Personal Data Processing Policy is available to users on the Site and is updated as necessary. By using the Site after changes have been made, the user confirms their agreement with the new version of the terms.
